SUPPLEMENTAL TERMS FOR CASA BONITA FOUNDERS CLUB REGISTRATION
THESE SUPPLEMENTAL TERMS AND CONDITIONS (THE "FOUNDERS CLUB TERMS") APPLY TO YOUR USE OF THE CASABONITADENVER.COM WEBSITE ("SITE") TO APPLY FOR MEMBERSHIP IN THE CASAS BONITA FOUNDERS CLUB. THE USE OF THE SITE AND MEMBERSHIP IN THE FOUNDERS CLUB IS ALSO SUBJECT TO THE CASA BONITA WEBSITE TERMS OF USE (INCLUDING, FOR AVOIDANCE OF DOUBT, ITS DISCLAIMERS OF WARRANTY, LIMITATIONS OF LIABILITY, AND ARBITRATION AGREEMENT) AND OUR PRIVACY POLICY, WHICH ARE AVAILABLE AT https://www.casabonitadenver.com/terms-of-use AND https://www.casabonitadenver.com/privacy-policy AND ARE INCORPORATED HEREIN BY REFERENCE. UNLESS OTHERWISE DEFINED IN THESE FOUNDERS CLUB TERMS, CAPITALIZED TERMS USED HEREIN HAVE THE MEANINGS PROVIDED IN THE WEBSITE TERMS OF USE. IN THE EVENT OF A CONFLICT BETWEEN THESE FOUNDERS CLUB TERMS AND THE WEBSITE TERMS OF USE, THESE FOUNDERS CLUB TERMS WILL CONTROL, BUT ONLY TO THE EXTENT OF THE CONFLICT. BY APPLYING TO JOIN THE FOUNDERS CLUB, YOU (A) ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO THESE FOUNDERS CLUB TERMS, THE WEBSITE TERMS OF USE AND OUR PRIVACY POLICY, AND (B) AFFIRM THAT YOU ARE AT LEAST 18 YEARS OF AGE AND A LAWFUL RESIDENT OF THE UNITED STATES. IF YOU DO NOT AGREE TO THESE FOUNDERS CLUB TERMS, THE WEBSITE TERMS OF USE OR OUR PRIVACY POLICY, YOU ARE NOT PERMITTED TO BECOME A MEMBER OF THE FOUNDERS CLUB.
Eligibility and Enrollment.
Membership in the Founders Club is available only to legal residents of the United States who are at least 18 years old. Eligible individuals who have provided their email addresses on the casabonitadenver.com site before August 31, 2024 will be invited to enroll in the Founders Club by September 5, 2024. Eligible individuals may enroll by providing their name, birthdate, personal telephone number and mailing address on the Founders Club registration page that's emailed to them. Eligible individuals may apply for and receive only one membership per person. Registration must be completed before October 1, 2024.
Your enrollment is not effective until it has been accepted and activated by the Company, which the Company may elect to do in its sole discretion. If a Member (defined below) is determined to be ineligible after enrollment, the Membership will be terminated immediately, and no compensation, or other benefits will be paid or due or redeemable. Eligibility in the Founders Club is void where prohibited by law in any state, county, or local jurisdiction where the applicant or is domiciled.
Membership.
Once your membership in the Founder's Club has been accepted and activated, you become a "Member" with access to certain perks offered on and through the Site (a "Membership"). Each Membership and the rights and privileges provided to each Member are personal and non-transferable. Any Member's account deemed to be used for business purposes may be revoked at the Company's sole discretion.
By joining in the Founders Club, Members agree to receive email phone communications including, but not limited to, information about the Member's account and the Founders Club, and commercial email from the Company. If you no longer wish to receive such communications, please unsubscribe by sending an email with your account number to hola@casabonitadenver.com.
A Member may cancel his or her Membership at any time by email to hola@casabonitadenver.com that includes the request to cancel along with the person's account information.
Changes
The Company may discontinue the Founders Club and may add, modify, delete, or otherwise change these Founders Club Terms, and any of the rules, procedures, conditions, perks or requirements pertaining to Memberships, with or without notice.
The Founders Club program has no predetermined termination date and may continue until the Company decides to terminate it, which may occur at any time, for any or no reason, and with or without notice to Members. The Company also reserves the right, in its sole discretion, to discontinue membership for any Member who:
- uses his or her Membership in any manner inconsistent with these Founders Club Terms;
- violates or acts in any manner that is inconsistent with federal, state or local laws; or
- engages in abusive, disruptive, inappropriate, or hostile conduct toward any employee, representative or customer of the Company.
